킹스톤 카운슬…계속된 한인사회 불법행위 단속, £2500 벌금 맞은 한인업체도
2년만에 또다시 한인비디오가게와 업자들이 불법행위로 벌금형과 영업정지 등의 철퇴를 맞았다.
킹스톤시(카운슬)는 최근 한인 비디오업체를 단속하는 한편 한인회를 통해 불법행위 근절을 촉구하는 공문을 전달했다.
시청의 상거래표준국(Trading Standards Dep’t:TSD)은 한인회와 한인업소 등에 보낸 글을 통해 “영국에서 유통되는 모든 영상물(비디오, DVD, 영화 등)은 영국 영상물등급위원회(BBFC)의 심사를 반드시 거쳐야 하며 이를 지키지 않으면 불법이다”고 밝혔다.
TSD의 테드 포시스 과장Chief Trading Standards Officer Ted Forsyth은 “최근 몇 년간 우리는 BBFC 등급심사를 받지 않은 한국어 비디오영상물을 판매 혹은 대여하는 사례를 적발했다. 킹스톤에 사는 다른 소수민족과 마찬가지로 법관련 홍보와 함께 단속활동을 펼치고 있다. ‘불법비디오’ 판매·대여의 행위에 대해 경고조치를 취한 후에도 계속 영업하는 업자들이 있음을 우리 직원들은 알고 있다. 최근에는 어느 (한인)업자에게 벌금 £2,500를 물린 바 있다. 한국에서의 등급심사는 영국과는 다를 수도 있다. 법을 잘 알고 지켜주기를 바란다”고 이 글에서 설명했다.(킹스톤 TSD 020 8547 5513)
■ 한국영상물 왜 심사 안받지?
BBFC가 등급심사하며 받는 수수료가 큰 부담. 또 한국어로 된 대사를 영어로 어떻게 이해시킬 것인가도 힘든 과제다.
100분짜리 영상물 심사비만 £600정도. 인기있는 연속극의 경우 16∼20시간 분량으로 1편당 £10,000(1900만원) 정도로 돈감당이 어렵다.
영화보다 비디오, DVD 심사가 더 엄격하다. 영화관람객은 극장입구에서 제한이 가능하지만 비디오 등은 부모와 함께 혹은 개인적으로 규제없이 볼 수 있기 때문이다.

British Board of Film Classification의 약자.
1984년 비디오 영상물관련법The Video Recording Act 1984에 따라 비디오테이프, DVD 등의 심사·등급판정 권한을 갖고 있다.
BBFC의 연령등급(U, 12, 15, 18 등)이 없는 영상물을 영국에서 판매·대여하는 행위는 불법이다.
2년전 ‘한국비디오’가 문제되었을 때 주영대사관 공보과에 연간 대여비디오 편수, 예상대여료 등의 자료제공을 요청한 적이 있다.
■ 2년전에 비해 무엇이 달라졌나
2003년 본지 김남교 칼럼 ‘대사님 연속극 보는 재미 찾아주세요’를 통해 한국 비디오 불법유통이 공론화됐다.
주영대사관(당시 이태식 대사)은 BBFC가 영국에 사는 다양한 소수민족 언어로 된 영상물과의 형평성 때문에 한국어 등급판정 면제가 어려울 것으로 판단, 양국간 등급판정 상호면제에 대한 협약체결 가능성을 한국 문화관광부 등 관계부처에 검토·요청중이라고 밝힌 바 있다.

Kingston Council’s Trading Standards Department is offering advice to Korean business people thinking of supplying Korean language videos.
Videos have to be classified by the British Board of Film Classification (BBFC) for their age suitability, for example U (unclassified) 12,15,18, before they can be supplied in this country even though they may be in the Korean language. Anyone wishing to sell or hire out these videos should get advice and look at the BBFC website

The Council’s Trading Standards Department is responsible for consumer protection type legislation in this borough, such as the Video Recordings Act, which makes it illegal to sell or hire videos without BBFC age classification. This Act of Parliament was made following public concern about the unsuitable content of videos that were being sold or hired to the public and says that virtually all types of videos, whether in English or any other language, would have to undergo the same type of age classification as films at the cinema. This means that videos ranging from horror down to television dramas must be classified by the BBFC before they can be hired or sold.
Kingston’s Chief Trading Standards Officer Ted Forsyth said, “Over recent years we have found a number of instances of Korean videos being sold or hired where they had not been classified by the BBFC. As with other minority communities supplying videos in Kingston, we have offered advice on what the law says, but we have a duty to enforce the law and on a number of occasions my officers have found people continuing to supply unclassified videos even after being warned. In one instance a person was recently fined £2500 for continuing to supply these videos despite our warnings. I would urge anyone thinking of supplying videos or DVDs to seek advice before starting to ensure that they are aware of laws that need to be complied with.
Unfortunately, the classification procedure is different in Korea and a video that has been classified there may well have a different age classification in this country.”
