학생비자법 변경과 학교 준수 사항 [영국대표 한인신문]

영국 이민국은 지난 3월 30일 이후에 영국에 입국하거나 체류 연장을 하고자 하는 학생들에게 점수제 이민법 4 등급을 적용하고 있다.
학생비자와 학교들에 대한 변동 사항을 3가지로 나누어 연재한다.
이번 주에는 각 학교들이 꼭 지켜야하는 요구 사항을 살펴보고 다음 주에는 체류허가 기간과 취득해야 하는 점수에 대해, 마지막 셋째 주에는 새로운 방식이 초래할 수 있는 어려움에 관해 설명하겠다.

◇ 학교 등록= 학교나 컬리지는 반드시 학생들을 스폰서해야 하며 영국 이민국의 ‘스폰서 등록부’에 등록해야 한다. 만약 학교나 컬리지가 ‘스폰서 등록부’에 등재 되어 있지 않으면 학생체류허가 신청이 거절될 것이다. (스폰서 등록부 : www.ukba.homeoffice.gov.uk)

◇ 학습 과정= 학교나 컬리지가 영국 이민국에 등록되어야 함은 물론이고, 수료하고자 하는 과정도 영국 이민국이 발행한 안내서가 요구하는 기준에 부합하는 충분한 난이도가 있어야 한다. 이러한 요구 조건들은 이전의 학생 입국조건 보다 조금 더 까다로워지기는 했지만 거의 비슷하다. 특히 학생들이 등록한 학교가 아래 조건들 중 한 부분에 부합한 학습과정을 반드시 제공해야 한다.
여러분이 18세 이하의 학생인 경우에는 ■국정 교과 과정에 준하는 풀 타임과정을 이수하거나 ■국가기능자격제도에 준하는 자격증 또는 기존의(통상적이라고 알려진) 사립학교 검열 기준에 준하여 교육받아야 한다.
사립학교 분야는 관련 법에 따라 사립학교 검열관에 의한 평가에 따르며 이는 이 부문의 규정들에 자동적으로 부합되게 될 것이다. 기존 기준에서 새로운 기준으로 변경된 것은 아주 미미하며 16세 이하의 학생들에게는 거의 영향을 미치지 않을 것이다.
16~17세 학생들은 이전 규정에 따라 풀타임 과정의 학생이었음을 증명했지만 지금은 이수하고 있는 과정이 국정교과과정에 따른 과정이라는 점이나 인정된 자격을 취득할 수 있음을 추가적으로 증명해야 한다. 영향을 받을 학생이 많지는 않을 것이다.

◇ 성인학생의 경우= 성인학생의 경우에는 아래 조건 중 하나에 부합한 풀타임과정을 이수하고 있음을 증명해야 한다.
■국가 기능자격(NQF) 3등급 이상 과정에 있거나 ■영국 학위에 준하는 해외 고등 교육기관에서 자격 취득 과정으로 영국에 있는 단기 해외 학습 프로그램에 있거나 ■유럽 공동체 언어 기준의 A2등급의 영어언어과정이어야 한다. 첫과정후 다른 영어언어과정을 이수하고자 하면 취득한 영어 언어 등급의 공식적인 평가서를 첨부해야 한다.

◇ 점검사항= 학생들이 학교나 컬리지 등록 전에 반드시 “학교 또는 컬리지가 스폰서 등록부에 등록 되어 있는가?”를 확인해야 한다.
최근 영국 이민국에 스폰서 등록을 신청한 학교 또는 컬리지들의 4분의 1가량이 거절되었다. 만일 학생들이 학생비자를 신청하거나 연장할때 다니는 학교가 새로운 이민법 규정에 적합하지 않아 등록이 거절된 곳이라면 체류허가가 거절되기 때문에 반드시 스폰서 등록 여부를 확인해야 한다.

Tier 4 of the points based system (Students visa)

Students wishing to come to the United Kingdom or to extend their permission to remain after the 30th March 2009, will have to do so under Tier 4 of the points based system.
This is the first of three articles on this new scheme.
This week, I shall discuss the requirements that the Colleges must meet. Next week I shall set out the periods of leave to remain that will be granted and the points you must score. In the third week, I shall outline difficulties the new scheme may cause.

◆Registration of School
Your school or College will now be responsible for sponsoring you, and your institution must be included on the UK Border Agency’s ‘Register of Sponsors’. If your school or College is not on the register of sponsor’s then your application to stay as a student will be refused. The Register of Sponsor’s can be obtained from www.ukba.homeoffice.gov.uk

◆The Course of Study
Not only, must the School or College be registered, but the course itself must be of sufficient complexity to meet the guidance published by the UK Border Agency. These requirements, are similar although slightly more restrictive, to the previous conditions of
the Immigration rules for student’s courses. Specifically your registered school must be offering a course of study which falls within one of the following:
If you are a child under the age of eighteen: then you must follow a full time course of study which must be taught in line with the National Curriculum;
or to a qualification within the National Qualification Framework (NQF);
or taught in line with existing (also known as prevailing) independent school education inspection standards. The independent schools sector is subject to assessment by the Independent Schools Inspectorate by law, and would automatically comply with the terms of this section. The change from the existing criteria to the new criteria is very slight and is unlikely to affect any children under the age of sixteen.
For children aged sixteen to seventeen, all that they had to show under the old rules, was that they were on a full time course of studies. Now, they must additionally show that the course of studies, is also is one of those which will either follows the national curriculum, or would achieve a recognized qualification. There are few who will be affected.

◆For Adult students
An adult student will have to show that he is on a full time course of studies, that meets one of the following: approved at level 3 or above on the National Qualifications framework (NQF).
Or
are short-term study abroad programs in the United Kingdom as part of your qualification at an overseas higher education institution, equivalent to a British degree.
Or
an English language course at level A2 of the Common European Framework of Reference for Languages. If you want to do another English language course after your first course, you will need to show a formal assessment of the English language level you obtained.

◆Revision notes
The essential question for you to answer is as follows:
“Is my school or College, on the register of Sponsors?”
Almost one quarter of those Schools and Colleges that have applied for the register of sponsors have been refused. If your School or college is not on the register, then your own permission to remain will be refused.
